1. Application of these terms
These Terms and Conditions apply to website use, cake and cupcake enquiries, quotations, bookings, collection, delivery and related services supplied by Artistry Cake Stylist. By confirming an order or paying a deposit, the customer accepts these terms.
2. Enquiries and quotations
Website estimates and published prices are starting guides only. A final quote is based on cake size, layers, servings, flavour, filling, design complexity, colours, piping, decorations, florals, toppers, delivery and setup requirements. Quotes may have an acceptance deadline and are subject to availability.
3. Booking confirmation
Submitting the website booking form does not reserve a date. A booking is confirmed only after Artistry Cake Stylist confirms availability, the customer accepts the final quote and the required deposit has cleared.
4. Notice periods
A minimum of seven days’ notice is generally required. More notice may be required during busy periods or for detailed, floral, personalised or specialty designs. Urgent orders may be declined or may attract an additional charge.
5. Deposit and payment
A non-refundable deposit of 50% is required to secure the booking date. Final payment is due three days before collection or delivery unless another date is confirmed in writing. Orders may not be released until full payment has been received.
6. Changes and cancellations
Requested changes are subject to availability, timing and additional cost. Significant changes may require a revised quote. Deposits are non-refundable because ingredients, decorations and production time may already have been committed. Cancellation fees may apply and amounts already paid may be retained to cover work completed and costs incurred.
7. Design interpretation and variations
Reference images are treated as inspiration. Handmade cakes may vary slightly in colour, placement, piping, florals and finish. Artistry Cake Stylist may make reasonable design adjustments where ingredients, decorations or flowers are unavailable, while preserving the agreed overall style and value.
8. Allergens and dietary requests
Cakes are prepared in a kitchen that handles gluten, wheat, dairy, eggs, soy and nuts. Although reasonable care may be taken with dietary requests, an allergen-free environment cannot be guaranteed. Customers are responsible for informing guests of relevant allergen risks.
9. Fresh flowers and customer-supplied items
Fresh flowers, toppers, decorations or other items supplied by a customer or third party must be suitable for food presentation and provided by the agreed deadline. Artistry Cake Stylist is not responsible for defects, contamination, breakage or delay caused by unsuitable third-party items.
10. Collection
Responsibility for the cake passes to the customer on collection. Cakes should be transported on a flat, stable surface in an air-conditioned vehicle and stored according to any instructions provided. Artistry Cake Stylist is not responsible for damage after collection.
11. Delivery and setup
Delivery and setup are subject to availability, access, distance and an additional fee. The customer must provide accurate venue details and safe access. Delays outside reasonable control may affect delivery times. Responsibility passes to the customer or venue representative once delivery and any agreed setup are complete.
12. Display and storage
Cakes must be kept away from direct sunlight, heat, humidity and unstable surfaces. The customer is responsible for suitable refrigeration or air conditioning where required and for following storage and serving instructions.
13. Photographs and promotion
Artistry Cake Stylist may photograph completed cake work and use cake-only images in its portfolio, website or social media. Customers may request in writing before collection or delivery that their cake not be published.
14. Liability
To the extent permitted by law, Artistry Cake Stylist is not liable for indirect or consequential loss, venue handling, customer transport, unsuitable storage, third-party decorations or circumstances outside reasonable control. Nothing in these terms excludes rights that cannot lawfully be excluded under the Australian Consumer Law.
15. Website content
Website content, photographs, estimates and availability may change without notice. Reasonable care is taken with published information, but final written quotations and booking confirmations take priority over general website information.
16. Governing law
These terms are governed by the laws of Queensland, Australia. The parties submit to the courts and tribunals with jurisdiction in Queensland.
